Brickbats to Gov. Rick Scott for continuing to appeal Florida’s welfare drug-testing rule. A federal appeals court has upheld the temporary ban on Florida’s law, saying an American Civil Liberties Union lawsuit against the state has a good chance of succeeding. Scott, who vowed to fight the ruling all the way to the U.S. Supreme Court, “The court’s ruling today is disturbing.” Justice Rosemary Barkett, 11th U.S. Circuit Court of Appeals, wrote, “The only known and shared characteristic of the individuals who would be subjected to Florida’s mandatory drug testing program is that they are financially needy families and children.”
